Terms of Service

1. MemorySanctuary

MemorySanctuary provides tools for creating shared digital Sanctuaries containing contributed stories, memories and photographs about a person being remembered.

You must be legally able to enter into these Terms. The service is not intended for children under 13 to independently create accounts.

2. Core and Premium

Core is not a trial. Core is the complete no-cost plan, has no trial period or automatic expiration, includes one creator-owned Sanctuary and provides 2 GB of storage.

Premium is an optional recurring subscription with a 25 GB storage allowance. Premium does not place privacy, Trust, reporting, account-deletion or Sanctuary-deletion rights behind payment.

MemorySanctuary is designed for long-term remembrance but does not guarantee permanent, perpetual or “forever” service, storage or availability. Keep independent copies of irreplaceable originals.

3. Subscription, renewal and authorization

Before purchase, Stripe checkout displays the price, currency, billing frequency and payment details for the selected monthly or annual Premium plan. By authorizing payment, you agree that Premium renews automatically at that frequency until cancelled.

Taxes may apply. A plan change takes effect only after Stripe confirms the transaction; returning from Stripe does not by itself activate Premium.

4. Cancellation, refunds and payment recovery

You may schedule cancellation from My Account. Unless applicable law requires otherwise, cancellation takes effect at the end of the already-paid billing period; Premium and its storage allowance remain available through that date. You may revoke a scheduled cancellation before it takes effect.

Charges already paid are non-refundable except where required by law or expressly stated at purchase. Confirmed refunds, reversals, disputes or chargebacks may adjust the subscription and transaction record. Contact Help promptly if you believe a charge is incorrect.

A confirmed failed renewal starts one fixed 30-day Payment Recovery period. Premium access and the 25 GB allowance continue through the exact deadline shown in My Account. You may update payment details securely through Stripe. A successful payment before the deadline restores normal billing status.

5. Core Preservation and storage overflow

If Payment Recovery expires without successful payment, the account moves non-destructively to Core Preservation. The standard allowance returns to 2 GB and new storage growth may be restricted.

Existing content above the Core allowance is preserved rather than immediately deleted solely because of cancellation, downgrade or failed payment. MemorySanctuary may limit new uploads while usage exceeds the applicable allowance and will provide notice before any materially different overflow treatment.

6. Stripe and billing records

Stripe processes payment methods and provides hosted checkout and billing management. MemorySanctuary does not receive or store raw card numbers or card security codes.

MemorySanctuary retains limited billing and transaction evidence—such as Stripe customer, subscription, invoice and event identifiers; plan, amount, currency, status and timestamps; and refund, reversal or dispute status—as reasonably required for accounting, tax, fraud prevention, dispute handling, security and legal compliance.

7. Account deletion and retained financial evidence

Account deletion is governed separately from subscription state and does not erase shared Sanctuary content automatically. Sole Stewards must first resolve stewardship or intentionally delete the Sanctuary through its governed process.

When an eligible paid account is deleted, unnecessary internal linkage between the deleted account and retained transaction evidence is removed. Limited financial records may remain where reasonably required for the purposes above; retained evidence does not preserve ordinary account access or revive a subscription.

8. Your content and Sanctuary roles

You retain whatever ownership rights you lawfully hold in original content you submit. You grant MemorySanctuary a limited, non-exclusive permission to host, store, reproduce, format, process, transmit and display it as reasonably necessary to provide, secure and operate the service.

Steward, Administrator and Contributor roles control platform permissions; they do not determine legal ownership or settle personal disputes outside the platform. You may contribute material only when you have sufficient rights or permission.

9. Visibility, moderation and safety

Private Sanctuaries are limited to authorized members; Unlisted Sanctuaries may be viewed by anyone with the link; Public Sanctuaries may be viewed without membership. Consider the current visibility before contributing.

MemorySanctuary may restrict content, activity or accounts when reasonably necessary to address fraud, impersonation, harassment, privacy or safety risks, copyright complaints, illegality, security threats, or violations of these Terms or Community Standards.

10. Deletion, availability and service changes

Sanctuary deletion is a deliberate Steward-controlled process with a recovery period. Deletion may not immediately erase temporary backups, security records or information reasonably retained for legal, fraud-prevention, accounting or security purposes.

Features may change and interruptions may occur. Material changes to these Terms or paid-plan treatment will be communicated as appropriate; continued use after an effective change may constitute acceptance where permitted by law.

11. Disclaimers and responsibility

The service is provided on an “as available” basis to the extent permitted by law. MemorySanctuary does not warrant uninterrupted operation or that contributed recollections are complete or accurate. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.

For a privacy, Trust, safety, ownership or copyright issue involving Sanctuary content, use Report a Concern from that Sanctuary and select the applicable category.
